Misuse of Drugs (Lawful Personal Use of Cannabis) Amendment Bill 2026

This Bill amends the Misuse of Drugs Act 1981 to make it lawful for adults to possess, use and cultivate limited amounts of cannabis for personal use — treating Western Australians as the responsible adults they are.”

Key Provisions
What the Bill actually does — in plain English.
Grow Up to 6 Plants
Cultivate up to six cannabis plants at your principal residence.
Possess Up to 50g
Hold up to 50 grams of cannabis for personal use — not in public.
Gift & Share
Give up to 50g to another adult. No sale, no commercial activity.
Protect Children
No smoking near children. Intervention requirements still apply to minors.
Private Use Only
No public consumption. Use is restricted to your own home.
Infringements Cleared
Existing adult Cannabis Infringement Notices for now-lawful conduct will cease.
What This Means For You
If this Bill passes, adults in Western Australia will be able to grow a small number of cannabis plants at home, keep up to 50 grams for personal use, and share with other adults — all without fear of criminal penalty.
You won't be able to sell it, use it in public, or smoke it around children. This isn't a free-for-all — it's a sensible, regulated framework that treats adults like adults.
If you currently have a Cannabis Infringement Notice for something that would be legal under this Bill, that notice will cease to have effect under the transitional provisions.
Important: The Bill has been tabled but has not yet passed. Current laws still apply until this Bill receives Royal Assent.
